Jerrys Mosaic Enterprise's Terms and Conditions
Please read these terms and conditions carefully before placing any order from Jerry’s Mosaic. By placing order, you accept these terms and conditions in full, and you agree to be bounded by them as final. Do not place any order if you disagree to any part of the terms and conditions stated below:
Definitions
‘Seller’ refers to Jerrys Mosaic Enterprise.
‘Buyer’ refers to the person who accepts a sales quotation from the Seller, or whose order of the Goods is accepted by the Seller.
‘Goods’ refers to any products to be supplied by Seller to Buyer
‘Logistics’ refers to Lalamove, Grab, or any individual or company that directly delivers the Goods to Buyer's destination.
‘Couriers’ refers to a company that offer express services, tracking, and door-to-door delivery of parcel to Buyer's destination through days and from hub to hub. (Ninjavan, J&T, GDEX, etc.)
‘Visible Defection’ refers to a defect of tiles itself that can be observed easily with eyes before and during the installation process. This include: ➀ Crack, Chipping, or Breakages; ② Color differences; or any others defects deemed to be easily observed.
Sales of Goods
1. Goods sold are not returnable, refundable, and exchangeable, unless otherwise agreed.
2. Return/ Refund/ or Exchange of Goods can be considered only when:
3.1 A return charges of 30% of the Goods total amount is applied. Minimum return quantity is one full carton.
3.2 Goods is defective or different from agreed, and discovered before installing. No return charges applied.
3.3 Seller's mistake at calculating the correct quantity needed, and the surplus quantity is more than one full carton. No return charges applied.
3. The quantity of each items in every order is automatically added with additional quantity (3 - 10 UOM, or 5% - 10%) for wastage and spare usage. This is considered a normal buying process, any surplus within the specified range is not entitled for return, exchange, and refund.
4. Any dates quoted for delivery of Goods are approximately only, delays may occur. Seller is not liable for any loss or any consequences suffered by the Buyer caused by delay in delivery of Goods howsoever.
Quotation & Invoice
5. All prices are subject to change without prior notice.
6. Price given in quotation is only valid for 30 days from the date of quotation if no deposit has been paid. We reserved the rights to provide an amended quotation afterwards.
7. Any quotation shall not be construed as an offer or obligation to sell, we reserves the right to accept or reject any orders received.
8. Unless otherwise agreed, a minimum deposit of 50% of total amount in quotation and invoice is required in order to confirm the order and reserve the quoted price and goods. Deposit is non-refundable.
9. Unless otherwise agreed, the invoice is only valid for 3 days if no payment has been made.
Warranty of Goods
10. Malaysian Standard allows a tolerance of ± 0.5% in size variation. Any size variation within this tolerance should not be considered a reason for rejection or replacement.
11. Seller will not take any responsibilities for the loss and damages of Goods that occur during the delivery process of the Logistics who is not appointed by Seller.
12. Seller will not take any responsibilities for loss and damages of Goods that occur during the shipping process of Couriers.
13. Visible Defection shall be noticed by the Buyer before installing, and is entitled for exchange/ refund. Seller will not accept any responsibility once the Goods have been installed.
14. Seller do not provide any form of warranty after installation. The defection after installation (Eg. Tiles pop-up, Cracked, etc.) is mainly due to thermal expansion, poor workmanship, weak adhesive, and heavy foot traffic. Seller is not liable to the defection from this varieties of causes.
15. If any defection are deemed to be liable by Seller, the only remedies is to refund for the defective Goods only. Seller will not compensate any other than the refund amount of the defective Goods. Seller is not liable for any loss or any consequences suffered by the Buyer caused by the defection howsoever.
